The Nancy Hollebeke Case, the Truth and the Whole Truth Part II

This is the second installment in a series on the Nancy Hollebeke case. My involvement in this case has ultimately led to my running for District Attorney. When I refer to attorney Stuart Leeds and our client Ms. Nancy Hollebeke, I will refer to them as Stuart and Nancy.

So Stuart was appointed to represent Nancy on charges of lying to the police. Here are the facts that he gathered:

-Nancy (Nancy was 18) had gone to a party in the desert with some friends.
-The party was at night and there were a bunch of kids there.
-Nancy helped serve beer from a keg;
-Nancy along with other kids from the party took off when they saw that the police had come;
-Due to the dark, Nancy was separated from her friends.
-She hid under a tree/shrub.
-Two cops found her.
-They started to pull her out and she told them that she would come, that she was not resisting.
-It was very dark.
-She felt herself on her back and hands groping her;
-She felt her pants (which were low hip huggers) come down;
-She struggled;
-She felt something go inside of her vagina;
-She then felt some liquid being poured over her on her crotch area.
-She heard laughter;
-The cops yanked her up;
-The cops walked her up to where there was another cop with her friends;
-She could see the two cops now and they were hispanic;
-She was crying and yelling at them that they were not going to get away with what they had done;
-The cops escorted her and some other kids to the street;
-Nancy was separated from her friends and cuffed and put in a patrol unit by herself; No one else was.
-Nancy reacted to this with fear; she was crying uncontrollably trying to kick the car door open. She was afraid they were going to take her somewhere else and do something else to her.
-This went on;
-Another cop told Nancy's friend that she could approach Nancy in the patrol car only if she could calm Nancy down;
-Nancy's friend went to the car and told Nancy to calm down. Nancy told her friend right then and there that the cops had raped her (in the law, this is called an "immediate outcry." Rape cases that have immediate outcrys tend to be stronger than those with delayed outcrys because when someone immediately reports somethng vs. waiting the allegation is usually more credible.)
-Eventually the cops release Nancy. Her friends take her home;
-Before leaving Nancy and her friend ask for the cops' names and they give them two names that do not correspond with their actual names;
-Nancy can hardly talk in the car and when she arrives at home and her father answers the door and sees her condition he immediately gets his wife up. Nancy is so hysterical that she can hardly relay what happened to her. Also important to note, her hysteria led her facial muscles to involuntarily contort and twitch. ( A person's demeanor is very important when evaluating a case. It is near nigh impossible to cause your face to twitch).
-Nancy told her parents that she had been raped by two cops (This is another immediate outcry).
-Her parents took her to Sierra hospital (Nancy sought immediate medical attention, another factor when weighing the credibility of an accusation);
-There she was examined by the staff;
-Her face continued to contort and twist;
-The nurse reported that Nancy was polite, articulate and cooperative;
-The doctor found a two millimeter tear in her vagina and marked it on her chart;


-The police were now swarming all over the hosipital; Detective Brigette Ballou was assigned to the case. Remember her name.
-The police sent in a MALE in uniform to photograph Nancy's vagina;
-Nancy was horrified by the sight of the male cop trying to photograph her in stirrups and she resisted the photograph being taken. Ms. Hollebeke, Nancy's mother, who was in the room, calmed Nancy down and explained to her that the police were there to help her and to not be afraid.
-Nancy was officially discharged from the hospital around 7 a.m. She had been there since early in the morning.

-At some point, Mrs. Hollebeke sees Jaime Esparza at the hospital;
-Esparza denies he ever went to the hospital;
-It is arranged that Nancy will be taken to the Children's Advocacy Center where she will give a statement;
-This is a deviation from normal procedure. Under normal procedure, an adult victim is taken to the station and there she gives her statement and it is typed up. Only children are taken to the child advocacy center.

Now enters Jaime Esparza, Karen Larose and Penny Hamilton, Esparza's top dogs at the DA's office.

The Nancy Hollebeke Case: The Truth and the Whole Truth Part I

What follows is the first part of the story of the Nancy Hollebeke case. There will be those readers of my blog who are completely familiar with this case and then there will be those of you who think you are familiar with this case because you watched some of it in the news or read accounts in the El Paso Times, and then there will be those of you who have never heard of this case. While writing this series, I will presume that my readership has no knowledge of the case and is reading from a layman's (not a lawyer's) point of view. For those of you who relied on the local media to inform you of this case or who heard accounts from police officers, I ask you to set aside what you think you know and try and read this with a clean slate and then form your opinions.--This case led to an awakening that has led to my bid for District Attorney.

The facts of this case and its legal proceedings catapulted my good friend attorney Stuart Leeds and me out of our regular law practices and into an alternate, parallel dimension which is in fact the true reality of the filthy, dirty practice of law in El Paso County, the corruption and reckless stupidity of our city representatives and mayor, the cowardice of lawyers and laymen alike who are willing to watch their neighbors be dragged out of their houses and lynched from trees, see no evil hear no evil judges, a police department that has been pervaded with deep-seated, dangerous corruption for years run by a hydraheaded monster disguised as respectable men in uniform, a press made up of more than one member that thinks nothing of writing and telling lie after lie and lastly a District Attorney so depraved and base in his moral character and judgement and so compromised as a politician that he is willing to strip innocent people of their freedom and dignity and standing in the community and all for what we have yet to find out.

Prior to representing Ms. Nancy Hollebeke, Stuart Leeds and I enjoyed active but uncontroversial law practices. We were on almost every judge's appointment list as lawyers to give work to as being diligent and aggressive on behalf of their clients. Stuart on occasion lunched with judges and both of us enjoyed many warm and open friendships of lawyers in the District Attorney's office. We were on the ****tail circuit as it were. But as you have rightly surmised, this nice, tranquil life came to an end. What we were exposed to at the Court House and what we learned subsequently about people we thought we knew was so shocking that it can only be likened to waking up and finding out that your spouse is not the law abiding CEO of a prosperous company but rather the murderous thug head of the mafia and you better quick come to because your sweet spouse is about to lay you open for your discovery.

On November 20, 2003, Stuart Leeds was court appointed by Judge Julie Gonzalez of County Court at Law Number Two, to represent Ms. Nancy Hollebeke who had been charged with a class B misdemeanor of "False Report to a Peace Officer." Stuart met with Ms. Hollebeke (hereinafter referred to respectfully as Nancy) and as is the common practice, he conveyed the DA's office's "offer" of PTD which is the acronym used for the first time offenders program. Under PTD you don't have to plead guilty. You attend classes once a month for 6 months to one year. At the end, the case is dismissed and you have no conviction on your record. Nancy told Stuart, whom she had just met, that he didn't understand, that she was guilty of nothing and would take no deals and that she had been raped by two cops and then was herself thrown in jail for reporting it. She told Stuart she wanted to go to trial to tell her story even if she had to be the defendant.

Although Stuart didn't convey this to Nancy at the time, he was stunned by what she had just told him. This was no typical false report case where some drunk had crashed his car, fled the scene and then called it in stolen to the police and then confessed to what he had done.-- Stuart did tell Nancy that he would look closely at the file and then call her and tell her what his advice would be. Stuart read Nancy's file and what he saw was just the tip of the iceburg of what there really was. What he read was a twisted, inverted upside down, macabre deviation of what should have happened when a female reports that she has been raped. And the female getting thrown in jail is not part of that procedure.

Bullies and Buggers CAN be Beggars

This week on May 22, 2007, my opponent had a fundraiser. I know about this not because he invited me but because other lawyers told me. Lawyer after lawyer told me that Esparza was making personal calls inviting people to attend and/or donate. One lawyer told me that Esparza called him no less than three times about the fundraiser and the individual still didn't go. Another lawyer said that Esparza called him and he never returned the call. Yet another lawyer said that he received two invitations in the mail from Esparza and he had not paid for them. Poor Esparza can't GIVE away the tickets.


According to a friend of mine in the office, there was a "request" that the employees attend the party. An acquaintance in attendance said that there seemed to be about 100 people with 35 of them being his employees. Part of that 100 was Esparza and his wife and his indispensible personal secretary Amy Lujan, Marcos Lizarraga and his wife, etc. My question is, is Esparza making all the phone calls during work hours or is he doing the honest thing and making them before or after work hours or is he making them during work hours and taking it as time off. Is his staff working on this campaign during work hours, making calls, sending out invitations, corralling the employees to go, etc? What's your vote? Is Esparza working illegally on the campaign during work hours on the government's nickle or is he this time doing the right thing?

In any event, Mr. Esparza who could hardly acknowledge the majority of the lawyers in the court house over the last 14 years (this is a very common complaint), the same lawyers and their clients he frequently practiced legal buggery on is now having to make calls and go begging for money and support from them.

Other Updates:

This week I spoke before a citizen group regarding my campaign. The reception was very warm and the point that appears to concern this group and others is the fact that Esparza has been there too long. One comment was four terms is too much (he is on his fourth term) and five terms is way too much. Another comment is that even if he started off honest, being there so long is bound to make him corrupt. Another comment is, why did he let Joe Wardy go when he was found to have a loaded gun at the airport?

Yesterday I received a call from a radio station in Austin, Texas. They wanted to interview me regarding Chief Wiles' bid for police chief in Austin. The reporter had found this website and my blogs in a search on Wiles on the internet. I did grant them the telephone interview. In the course of the interview I talked about the police regularly killing the mentally ill due to lack of training and Chief Wiles immediately, before any meaningful investigation could take place, whitewashing the killings. I also mentioned the six courts of inquiry on his department and the fact that two cops who are currently on the force and called to testify in court (by Esparza's office) are also currently out on bond for AGGRAVATED PERJURY (that means lying under oath). I also pointed out how this would be contrary to the rules of the "matrix" (punishment grid) Wiles put into place and is toting around. Finally I talked about Chief Wiles' disdain for the role of the judge in our judicial system as evidenced by the video I have placed on the front page of this website which you can click over and watch.

The power of the internet cannot be underestimated. And it is amusing watching bullies and buggers become beggars and writing about it here for your edification and enjoyment.


The Border Observer on the FBI, Jaime Esparza and the El Paso Times

This week on Tuesday, May 15, 2007, the El Paso FBI executed search warrants on the offices of County Judge Anthony Cobos and County Commissioners Miguel Teran and Luis Sarinana as well as others. Supposedly the FBI is investigating contracts relating to a company called Ready One or NCED and its subsidiaries. Bob Jones used to be head of Ready One and has been under investigation for a while.

The way the FBI conducted itself in the search and the way the El Paso Times covered the event, one would have thought that County Judge Anthony Cobos and Commissioner Luis Sarinana and not their physical offices were tragets of the search and were guilty of some federal offense. I have little if no insider knowledge of this particular invesigation but I do have a wealth of knowledge as to how this town works. And based on this knowledge I have some questions and these questions relate back to Jaime Esparza and his activities and his connections including how he handled the cases of George DeAngelis, Nancy Hollebeke, Deane and Diane Kinder, former FBI head Hardrick Crawford, former Mayor Joe Wardy, former Police Chief Carlos Leon who went on to became Chief of Security under Bob Jones at NCED/Ready One, etc. These are all topics that I plan to cover in one way or another during this campaign season as they illustrate what kind of a human being Jaime Esparza is and what he has been up to all these sad fourteen years.

All of the events unfolding this week are inter-related to the above list and pertinent to my race. The BorderObserver (which is a weekly newspaper, published by the family owned and very independent El Diario) featured an article and an editorial in its publication yesterday that all of you who read my blog and care about this town MUST read. Since we know the El Paso Times, whose editor is Don Flores, is agenda driven and relies on huge advertising accounts amounting to millions annually with government entities (which goes a long way to explain why they support every tax hike and bond issue and are slavishly devoted to certain members of government), we know that we must be very cynical about what we read by the Times. Times reporter David Crowder who has the county beat appeared on Channel 9 news (they share news) and as part of his report on the search of County offices, he actually said, "Some people beleive that where there is smoke there is fire." Why is Crowder implying Cobos is guilty of a crime. How can that be news reporting?

-Can we trust our government? What happens to us when we allow corrupt officials to flourish in office?
-When Former deputy police chief George DeAngelis reported to then police chief Carlos Leon that he had grave concerns that the drug cartel had infiltrated the El Paso police department, why did Leon turn on DeAngelis and why did Jaime Esparza indict George DeAngelis the whistle blower and not instead investigate who DeAngelis was reporting on?
-When George DeAngelis went to the FBI to report his information why did the FBI ignore him? DeAngelis had always been a credible person and was second in command of the police department. What happened?
-Why did the FBI sit back and do nothing when Esparza indicted DeAngelis and went on to have a feeding frenzy on DeAngelis while everyone watched on in silent horror? Esparza, Leon and the FBI still have bits of DeAngelis bone and gristle stuck in their teeth.
-What relationship did Esparza have with Former FBI head Hardrick Crawford?
-Why did the FBI and Esparza not notice that Crawford had very close personal ties to the Guardia family who owned the race track in Juarez and who had a very dubious reputation as being linked to drugs?
-How could Esparza and the local FBI sit and watch Crawford go on trips with Guardia, let Mrs. Crawford draw a salary from Guardia and not raise so much as an eyebrow?
-Why did it take the office of the United States Inspector General and not the FBI, to come down here and open an investigation on Crawford? This investigation ultimately led to Crawford's prosecution, conviction and prison term last August 2006.
-Where is Guardia now? Last account was he was on the run in Mexico?
-How in all this did Esparza look the other way when Police Chief Carlos Leon ordered another investigation of whistle blower George DeAngelis which resulted in the SECOND arrest of DeAngelis?
-Who is Woody Hunt?
-What connections does he have with the El Paso Times and certain government officials, if any?
-Why was it that when the Colorado papers were writing huge article after huge article about Hunt Corporation building military housing in Colorado where illegal labor was employed, there was nary a peep out of the Times for three whole days? Why would people in Colorado be more informed about Hunt Corporation than people in El Paso where Hunt is based?
-And why was it that when the Times did cover the story, THREE days later, it was all about how Hunt had nothing to do with the hiring of the illegal workers working on their project and how it doesn't matter because Hunt just got another gargantuan government contract anyway?
-What connection is there between Hunt and mega-billionaire Bill Sanders, if any?
-Why does the El Paso Times fully support Bill Sanders and the Paso Del Norte group's effort to get the city to condemn and seize land from private citizens so that he can develop it?
-Why do city leaders who support this taking of land not answer when directly asked, if tax dollars are going to be used to pay Sanders to develope the seized land?
-How is it that there is no investigation into the fact that Sanders is the father-in-law of City Rep. Beto O'Rourke and into the fact that the City Manager Joyce Wilson is also SIMULTANEOUSLY while the city is trying to take over the private land, the official spokesperson for the land hungry Paso del Norte Group Sanders is connected to?
-Why does the El Paso Times vilify the land owners who are trying to defend their property rights against a mammoth city government and a billionaire "developer" with a son-in-law on city council and a city manager connected to the billionaire and his group who want their land by painting them as tax cheats and scum bags when there is no proof of this at all?
-Why does the Times weekly attack the three members of council and the County Judge who are against the City Manager Joyce Wilson and the Sanders group and the land grab?
-Why was the El Paso Times so very against Anthony Cobos' bid for County Judge?
-Is it because Anthony Cobos is against Eminent Domain and Sanders' efforts to take the downtown land?
-Why did Times reporter Crowder say, "where there is smoke there is fire" when reporting on the search of Cobo's office? Could it have anything to do with Cobos wanting to pull the County's advertsing mega money contracts with the Times and opening them up for bid with the Times' adversary El Diario?
-Why has the Times not asked the question as to how Anthony Cobos could be a target of the FBI investigation of Ready One/NCED when he wasn't in office when contracts between the County and the company were signed?
-Former Mayor Joe Wardy took over Bob Jones' job at Ready One after it came out that Jones was being investigated.
-This is the same Joe Wardy who Jaime Esparza and the El Paso Police let go after finding a loaded gun in his bag at a secured area at the airport. If you, Joe citizen, showed up at the airport with a gun, the police would have hauled you in to Jaime Esparza who would have dragged your case before the grand jury so fast you would not have had time to breath. But Wardy can walk in with the gun LOADED and the police are slobbering all over themselves on TV excusing his actions as an accident and Esparza says he has nothing to do with it? Why?
-Can we trust the FBI?
-For years the FBI has received documented complaints regarding Jaime Esparza and they do nothing. Why?
-When attorney Stuart Leeds and I went to the FBI with a documented complaint on Esparza, they assigned one agent to attend one meeting and we never heard from them again. That was years ago. Why not talk to the witnesses, ask for more information? Others have gone to them as well about Esparza. They say they are waiting for a "Smoking Gun."
-This is the same FBI that was headed by the same Hardrick Crawford who has since been to prison.
-This is the same FBI attached to the same United States Justice Department headed by the same Attorney General Alberto Gonzales now under investigation by Congress for allowing his department to be used as guess what, a POLITICAL WEAPON. When asked to answer for his decision to fire US attorneys who refused to use their power for political purposes, Gonzales' only answers are that he can't remember and plus he is the son of poor Mexican farm hands and grew up barefoot in a dirt hut in Texas and then made it to Harvard. That's got to count for something when you use your office to break the law.--POBRECITO. Interestingly enough, the scandal broke when one of the fired US attorneys in Albuquerque, which is right down the road from here, went to the LOCAL press with the story. Can you imagine what would have happened to the same attorney here if he had gone to Esparza and the El Paso Times with the same story? Would it be unreasonable to think that the attorney would have been treated the same way George DeAngelis was which was to be arrested, thrown in jail and charged with a crime? Also keep in mind that US attorneys are the ones who ask federal judges for search warrants. If an US attorney thinks he might get fired for not seeking a search warrant on political enemies of those in power, you can see how easy it would be for a search warrant request to go out and for the system to be abused. Since we know that the Justice Department and the local FBI are riddled with scandal, can we trust them and their search warrants?
-Where is Jaime Esparza in all of this?
-If there is wide spread corruption going on in commissioner's court just one floor above his office, how come he never noticed?
-How come the only commissioner Esparza ever indicted was Betty Flores who was calling for an audit of Esparza's budget and drug asset forfeiture accounts?
-What is really going on?
-Follow the money.








New Blog Video/Public Confronts Jaime Esparza on Radio

For the blog readers who skip the home page, be sure to visit the the home page because I put up a new video yesterday. I also want to thank the people who have contacted my office to express their enthusiasm over my new billboard on I-10 which is in Spanish. The Spanish billboard message is the first that I have seen by a politician. I doubt that any prior candidate for D.A. has ever invested the money in a Spanish language billboard much less thought of it.

On another front today, my opponent appeared as a guest on the Paul Strelzin radio show. You should know some of the background to all of this. I sued Paul Strelzin for slander a few years ago. Months after I filed my lawsuit against him, management got rid of the show and with it, Paul Strelzin. Paul Strelzin now has another show on another station. Since I announced my candidacy in February, Strelzin has invited my opponent to appear on his show on a regular basis. This is the same Paul Strelzin who used his old radio show to promote his friends in power on the then city council to impose an 11.89% tax hike on the whole city while he happened to owe years worth of property taxes on his own home. He was on the radio day after day, month after month, bleating that we had to have this tax hike and if we opposed it we were against progress. When called to answer for his own tax deadbeat status, he just whined that he had to send kids to college. How would you describe the integrity of a tax deadbeat who promotes a tax hike on the rest of us who happen to pay our taxes? Esparza appears on Strelzin's show. Birds of a feather flock together.

Despite the screening process that one has to navigate to place a call to Esparza on the Strelzin show, which includes stating what you want to ask and having to call back, etc., people who monitored today's show called me and said that the first three callers out of the shoot were anti-Esparza. One person who monitored the show said that one of the first callers was an El Pasoan attending law school in Houston who called and tried to ask about how many terms Esparza had served. The listener said the caller touched a nerve in Strelzin because right away Strelzin went ballistic on the caller who was obviously taken aback at Strelzin's unwarranted vitriol. He said Strelzin was attacking the kid as being a set up call and really didn't let Esparza answer his question.

Another person who monitored the show said Esparza's voice sounded very shaaaaakkkkkkyyyyyy when answering a caller why he didn't prosecute Joe Wardy for having a loaded gun at the airport and why he is telling people that Wardy's case is a federal case when he has prosecuted others for the same thing. When asked about who sets the bond on DIMS cases, Esparza was clear in stating that "it is not the assistant D.A. who sets the bond." (Esparza's own written policies and procedures betray him. His written instructions to his staff clearly state that the assistant D.A. is to set the bond). The listener said that after that response the "rest of his answer was so convoluted you could not make heads or tails of it." The listener said "Esparza just went ramblng on and one wonders who he thought he was talking to."

According to another listener, a man called in complaining that Esparza had not responded to his several letters or calls regarding his son's case. The father was angry and upset and no amount of placating by Strelzin could get him off course. Strelzin told the father that he should leave his son's name with someone off the air so that Esparza could look into his son's case. The father said that Esparza should know who his son is since his son had to sue him in a federal civil rights lawsuit.

Through his non-answers today, Esparza also tried to leave the public with the impression that the federal courts had ruled that DIMS is legal. The federal courts declined to rule on the legality of DIMS so don't be tricked by Esparza's word smithing.

One of the people who listened said that it was clear that the questions were directed at Esparza but answered by Strelzin who is not a lawyer or the D.A. People need to ask Esparza why he doesn't answer the questions. The general assessment was that there are some angry people out there and Strelzin was running cover for Esparza and that Esparza was hiding under the studio table watching Strelzin run rough shod over the public just for him. This is typical of Esparza.

The listeners said it was very entertaining listening to Eparza face the public and listening to Strelzin get hot under the caller watching his screening mechanism be blown to pieces by the Truth. Let's hope Esparza goes on the Strelzin show some more. Esparza needs to face some more angry parents and to face our questions. The public knows when someone is running. Let Esparza evade the questions. Let Strelzin do Esparza's dirty work. People aren't blind.

You should also know that David K has a talk show right after the Strelzin show from 10:00 A.M. to 11:00 A.M., 1650 AM. I have been on David's show twice and he does not screen his calls. The calls come in and they are passed on to the host automatically. When I was on the David K show I answered all the callers and e-mails that came in. Real candidates for D.A. who don't need to hide behind screeners go on real not rigged talk radio which in this town would be the David K show.
