Theresa Caballero's Campaign Platform: Prosecuting Health Insurance Fraud

Prosecuting insurance companies who commit fraud has long been a cornerstone of Theresa Caballero's Campaign for District Attorney. This is a huge problem in El Paso County and Nationwide with insurance companies selling policies and then cutting people off when they get sick.

People are being struck down and left to die in the middle of their illnesses and the insurance companies are giving bonuses to their employees for disqualifying the sick people. This is called stealing and fraud and the consequences are the ultimate: death!

The current District Attorney has done absolutely nothing about this for 16 years. It is time for a positive change. When there was hue and cry against Young Insurance Company and Access Health Care, he did nothing.

Theresa Caballero, on the other hand, will form a Financial Crimes Unit (she has been talking about this for a year) and will investigate and prosecute this high level and most vicious form of theft.


It was reported yesterday, February 23, 2008, on page C-2 of the San Francisco Chronicle, under the headline: "Insurer must pay $9 million for canceling policy; Health Net dropped coverage for woman undergoing cancer treatment", that: (selected exerpts from Chronicle Staff and News Services follow)

"A Southern California woman who had her medical coverage canceled as she was undergoing treatment for breast cancer was awarded more than $9 million Friday in a case against one of California's largest health insurers."

...

"...arbitration judge Sam Cianchetti ordered Health Net to pay her medical bills, plus $8.4 million in punitive damages and $750,000.00 for emotional distress."

...

"Health insurers have come under fire from state regulators, attorneys and advocates for using mistakes or omissions in a member's application to justify canceling coverage after a policy holder becomes ill."

...

"Friday's award marked the first punitive damages ordered by a judge in a case against an insurer for rescinding policies."

But here is the truly remarkable thing about this case and how it ties in to Theresa Caballero's Campaign Platform on this issue:

"Friday's award capped a difficult week for the insurer, which included being sued by the Los Angeles city attorney on claims of unlawful and deceptive practices in connection with its rescission policies. City Attorney Rocky Delgadillo also said the company illegally ran an incentive program in which it paid bonuses to an administrator for meeting policy-cancellation targets."

This is good, innovative prosecution that the L.A. City Attorney is doing out in California. It is also exactly what Theresa Caballero has been talking about as one of her campaign platforms: To form a new Financial Crimes Prosecution Unit with real teeth to it. She will use her resources wisely and hire and assign forensic accountants to it as well as attorneys who are experienced and dedicated to the area of prosecuting this kind of high level theft. She has said they will have the expertise to "follow the money" trails! This is exactly the kind of crime Theresa Caballero will go after. You know she will. You know she is not scared of anybody. You know she owes no one anything. You know she knows who the real thieves are.

When is the last time you read or heard about the current DA going after these big insurance carriers or any other big crooks in his 16 years? We know he prosecutes the welfare mothers for stealing diapers at Wal-mart and that is as it shold be. But the prosecutions of the big crooks must also take place and that has not been happening.

So how can we expect him to address these issues of insurance companies committing fraud and public corruption? His record shows us that he won't.

El Pasoans need to protect themselves and their families by electing a new District Attorney who will go after the real crooks: politicians who sell their votes which results in higher taxes for all of us and health insurance companies who leave us to die in the gutter.

I have stated repeatedly that Theresa will be put in office by the little people. That's you and me El Paso! When I say little people do not ever think that I mean powerless. In numbers we can make the changes necessary to make El Paso a better place to live for generations to come. I for one, want my city back. I want to live in a city of the people, not the corrupt power mongers who sell their votes as if they were garage sale throwaways. How many of you reading this make less than $20,000 annually, how many single mothers out there struggle to survive, paycheck to paycheck? These people are the working poor, and El Paso is full of them. They are my neighbors and my friends, but first and foremost they are human beings, and when all is said and done we are all the same. Thank you Theresa for speaking out so eloquently for those of us who don't always have a voice.

Finally, someone in El Paso talking about taking on blue collar corruption. Shameful that your opponent hasn't done a thing except prosecute the poor and voiceless, all the while, giving his friends passes. We need someone like yourself looking out for us. We need you to help those who are unable to take on these glorious powers that be. I believe El Pasoans will see through your opponents do nothing approach (worse than do nothing because he actual prosecutes those who take on his friends).

One such company is Access Health in 1999 its owner Steven Young bilked the City County EPISD and YISD out of approximately $4,000.000.00 and Esparza refused to indict today Access Health is at the center if the corruption scandal Esparza could have prevented this but chose otherwise.

I watched the first installment of the KVIA story about the protection of Oceguedas ss#, and the failure to fairly prosecute an "alleged" child molester. Jaime Esparza supporters try to spin this case and pretend that Jaime Esparza acted appropriately. This is how it REALLY went down: Jaime Esparzas good friend(these are Esparzas words) and his personal secretary's brother(a coach in the SISD) was accused of sexually molesting a six year old girl in that district. The Police dept. found the child to be credible. Pretending to act with propriety Jaime Esparza "recuses" himself from the case. Jaime Esparza then hand-picks a special prosecutor (none other than Chris Bradley, who worked for Jaime Esparza and Amy Lujan(the sister of the accused and good friend to both Esparza and Bradley). Bradley decides that there is not enough evidence against her and Jaime Esparzas "good friend" and declines the case. Everything about this stinks! Jaime Esparza and Chris Bradley protected a "child molester" from prosecution, because they happened to be "good friends" with him. I wonder if they are "good friends" with Fernando Parra as well? Oh, that's right even though Fernando Parra worked in the same building as both of them, I'm sure that they had no idea that Fernando liked little boys. If I were a parent with a child in that district, I would pull my child out as long as this man was still employed with them. Of course being from Socorro, most of these people have no power or money, and therefore no voice. I could care less if this creep's personal information is released, it is this young girls well being I am concerned about. This is a perfect example of Jaime Esparza's complete control and manipulation of the judicial system. We in El Paso deserve better, and we will have better with a vote for TC on March 4th.

I wanted to say a few words about this process and make it clear I still believe TC can pull this off. I don't know any of you who blog here. I don't know Theresa or Stuart either, but I've been moved by the passion and loyalty to cause demonstrated by all of you. My world is very simple and strangely enough, even I have issues for which there is no justice. Makes for sleepless nights for many years. I think Theresa handled herself with wonderful poise even though it's clear what the motives of the powerful and their groupies have been. If I knew her, I would be proud of her. I'm proud to have voted for her and brought her to the attention of as many as possible. Thank you all for writing and laying the facts and feelings out for the public to scrutinize. This has been an experience.
